Apple vs Samsung trial: Apple wins.
APPLE vs SAMSUNG TRIAL VERDICT
The verdicts in and Apple has won a monumental victory in it’s case against Samsung.
After 3 days of deliberation, the jury delivered it’s unanimous verdict on Friday afternoon, but in our opinion the following picture says it all.
This in unlikely to be the end of the case as Samsung are sure to appeal but there’s no doubt this is a victory for Apple.
Developing…
Update 1: Apple have been awarded damages to the sum of
1 billion, 51 million 855 thousand dollars
Update 2:
In Samsung’s counter suit against Apple, the jury have ruled in Apples favour.
Update 3:
For those interested, The Verge has an insight into how the jury were asked to arrive at their decision and the detailed forms they filled in.
After a period of both Apple’s and Samsung’s lawyers checking over the verdict from from the jurors , a couple of minor inconsistencies have been found.
- The jury appears to have awarded damages for the Galaxy Tab 10.1 LTE infringing — $219,694 worth — but didn’t find that it had actually infringed anything.
- A similar inconsistency exists for the Intercept, for which they’d awarded Apple over $2 million.
This isn’t surprising given a complex case of this . The jurors are being informed of this by the judge as we speak.
Update 5:
As we’re waiting for the decision on the two inconsistencies above, Samsung have issued the following statement:
Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer
Update 6:
And now Apple have issued their reaction to the ruling;
We are grateful to the jury for their service and for investing the time to listen to our story and we were thrilled to be able to finally tell it. The mountain of evidence presented during the trail showed that Samsung’s copying went far deeper than even we knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, we value originality and innovation and pour our lives into making the best products on earth. We make these products to delight our customers, not for our competitors to flagrantly copy. We applaud the court for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right.
Update 7:
The Jury has come back and decided Samsung hadn’t infringed the patents in the two cases above. Damages have been reduced to $1,049,343,540
The Jury has been dismissed and this case is over. Until the appeal process starts.
